Terms of Service

1. The service

PackageIQ provides AI-assisted packaging analysis and strategic recommendations for manufacturers, brand owners, and distributors. Reports are generated by combining user-submitted product context with large language models and a curated research library.

Reports are advisory in nature. They do not constitute legal, regulatory, or engineering advice. You are responsible for validating recommendations with qualified professionals before making packaging or compliance decisions.

2. Account eligibility

• You must be at least 18 years old and capable of entering a binding contract
• You must provide accurate registration information and keep it up to date
• One person or legal entity may not maintain more than one free account
• Accounts may not be shared or transferred without our written consent

3. Tokens, payments, and refunds

Tokens

Access to paid features is denominated in tokens. 1 token = €1.00 at list price. Token packs and subscriptions are available at volume discounts. Tokens have no cash value and cannot be transferred to another account.

Free scan

The free packaging scan requires no account and no payment. It provides a summary assessment only; detailed findings, design proposals, and production files require token expenditure.

Payments

All payments are processed by our payment providers. By purchasing tokens you authorise us to charge your payment method for the stated amount. Prices include applicable VAT where required by law.

Refunds

Token purchases are non-refundable once tokens have been used to generate a report. Unused tokens from a token pack may be refunded within 14 days of purchase if no report has been generated using that pack. Subscription fees are non-refundable for the current billing period. 4. Acceptable use

You agree not to:

• Submit false, misleading, or third-party product data without authorisation
• Attempt to reverse-engineer, scrape, or extract the underlying AI models or research library
• Use the service to generate reports for resale without a written commercial licence
• Circumvent rate limits, access controls, or billing mechanisms
• Use the service in any way that violates applicable law or infringes third-party rights

We reserve the right to suspend or terminate accounts that violate these restrictions without notice.

5. Intellectual property

Your content

You retain ownership of the product information, images, and descriptions you submit. By submitting content you grant us a limited licence to process and store it for the purpose of generating your reports.

Reports

Upon payment, you are granted a non-exclusive, non-transferable licence to use the generated report for internal business purposes. You may share reports with suppliers, colleagues, or investors but may not resell or publicly republish them without our consent.

Platform

The PackageIQ platform, including its software, design, and research library, is our exclusive property. Nothing in these Terms transfers any intellectual property rights to you.

6. EU Packaging Regulation compliance

Reports may flag potential compliance issues under EU Packaging and Packaging Waste Regulation (PPWR) and related legislation. These flags are informational only. Regulatory compliance is your sole responsibility and must be verified with qualified legal and technical advisors. We make no warranty that flagged items represent an exhaustive list of applicable obligations.

7. Disclaimer of warranties

The service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that reports are accurate, complete, or suitable for any particular purpose. AI-generated content may contain errors; you assume all risk associated with reliance on report outputs.

8. Limitation of liability

To the maximum extent permitted by applicable law, PackageIQ's total liability to you for any claim arising from use of the service shall not exceed the total amount you paid us in the 3 months preceding the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable law.

9. Termination

You may delete your account at any time. We may suspend or terminate your account if you breach these Terms, with or without notice. On termination, your right to use the service ceases immediately. Unused tokens are forfeited on termination for breach; we may, at our discretion, refund unused tokens on voluntary account deletion.

A dispute over unused tokens does not delay a data erasure request made under our Privacy Policy: requesting deletion of your account and personal data is handled independently of any outstanding token balance.

10. Governing law

These Terms are governed by the laws of Bosnia and Herzegovina. Any dispute shall be subject to the exclusive jurisdiction of the courts of Sarajevo, Bosnia and Herzegovina, unless mandatory consumer protection law in your jurisdiction requires otherwise.

11. Changes to these Terms

We may update these Terms to reflect changes in the service or applicable law. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the revised Terms.
